REGULAR COUNCIL MEETING
July 6, 2010

7:00 P.M. meeting called to order in the Council Chambers at 322 Wilson Highway, Millsboro, Mayor Larry Gum presiding. Present were Vice-Mayor Bob Bryan, Treasurer Michelle Truitt, Council Persons John Thoroughgood, Irene Keenan, Greg Hastings, Town Manager Faye Lingo, Town Solicitor Mary Schrider-Fox, Development Coordinator Linda Johnson, Town Clerk Tammy Phillips. Tim Hodges, Secretary absent. Guests-- see attached

REORGANIZATION OF COUNCIL
  • Mayor - Bryan nominated, Thoroughgood second Larry D. Gum as Mayor. With no other nominations Bryan moved, Thoroughgood second to close the floor to nominations, approved unanimously. Vote called for, Gum for Mayor, approved unanimously with Councilman Hodges absent.
  • Vice-Mayor - Thoroughgood nominated, Truitt second Robert Bryan as Vice-Mayor. With no other nominations Hastings moved, Thoroughgood second to close the floor to nominations, approved unanimously. Vote called for, Bryan for Vice-Mayor, approved unanimously with Councilman Hodges absent.
  • Secretary -Keenan nominated, Bryan second Greg Hastings as Secretary. With no other nominations Bryan moved, Thoroughgood second to close the floor to nominations, approved unanimously. Vote called for, Hastings for Secretary, approved unanimously with Councilman Hodges absent.
  • Treasurer - Bryan nominated, Thoroughgood second Michele Truitt as Treasurer. With no other nominations Bryan moved, Thoroughgood second to close the floor to nominations, approved unanimously. Vote called for, Truitt for Treasurer, approved unanimously with Councilman Hodges absent.
  • President Pro-Tem- Bryan nominated, Hastings second Thoroughgood as President Pro-Tem. With no other nominations Bryan moved, Hastings second to close the floor to nominations, approve unanimously. Vote called for, Thoroughgood for President Pro-Tem, approved unanimously with Councilman Hodges absent.

All nominations were with no opposed officers Bryan moved, Truitt second to close the floor to nominations, approved unanimously with Councilman Hodges absent.

VILLAGES OF MILLWOOD - for the Millwood Expansion phase on Sussex County Map No,. 2-33-5.00 parcel 12.00. They received their preliminary plan approval in 2006 and had it extended for one year in 2009. They are asking for a second extension of time. Mark Prata, representative from Mitchell Ave Assoc., stated the parcel is west of the railroad and south of the Industrial St. Mitchell Ave Assoc., are negotiating with M & T bank for a new entrance on Industrial St. Bryan moved, Thoroughgood second to extend preliminary plan for one year July 2011. Motion approved unanimously with Councilman Hodges absent.

SECRETARY'S REPORT - Mayor Gum presented the minutes from the June 6, 2010 council meeting for Council's approval. Bryan moved Thoroughgood seconded to approve the minutes from the June 6, 2010 council meeting as written. Motion approved unanimously with Councilman Hodges absent.

TREASURER'S REPORT - Treasurer Truitt presented the bills and bank balances to Council for approval. Bryan moved Hastings seconded to pay the bills from the designated accounts as presented. Motion approved unanimously with Councilman Hodges absent.

GREATER MILLSBORO CHAMBER OF COMMERCE - Fran Bruce, Director, no report.

MILLSBORO FIRE COMPANY - Ron O'Neal, President, no report.

MILLSBORO POLICE DEPARTMENT - Chief Murphy stated on June 7th & 8th - Sgt Legates and Det. Wheatley attended Conducting Complete Traffic Stops at the University of Delaware. June 28th - All officers received in house recertification training on the Taser, OC Spray and ASP. June 28th - "A" shift completed a firearms qualification. Homeland Security threat level remains at yellow. No issues to report. Calea Update no issues to report. Chief Murphy stated that one refurnished car is back from painting and waiting for radio and graphic to be done. The two police cars at wastewater treatment plant are out of service and will be refurnished at a later date.

PARKS AND RECREATION REPORT - No report

STREET REPORT - No report

WATER AND SEWER REPORT - Faye Lingo, Town Manager, stated that well # 5 is up on running to test the membranes.

MAYOR'S REPORT -

Sign Ordinance - Mary Schrider-Fox, Town Solicitor, stated she is working on rewrites for sign ordinance. She stated that she should have them to Kyle and Town Manager by July 8th. The Town of Millsboro can publish draft and should be ready by August council meeting.

Ordinance amendment, bar, taverns. This discussion had begun a few months ago and a committee was appointed a that time ( Bryan, Thoroughgood and Keenan) Mayor Gum appointed the same committee. Bryan moved Thoroughgood second to ordinance amendment, bar and taverns. Motion approved unanimously with Councilman Hodges absent.

Job posting for an Assistant Town Manager, this was discussed during the budget process and the job description is in the packet. If agreeable we will proceed with advertising for the position. Bryan moved Thoroughgood second authorizing the position and to begin the advertising. Motion approved unanimously with Councilman Hodges absent.

7:27 pm Bryan moved Keenan seconded to adjourn. Motion approved unanimously with Councilman Hodges absent.

Executive Session at 7:45 till 8:00 pm

Regular Session

8:00 pm meeting called to order with Mayor Larry Gum presiding. Present were Vice Mayor Robert Bryan, Secretary Greg Hastings, Treasurer Michelle Truitt, Council persons John Thoroughgood, and Irene Keenan, Town Solicitor Mary Schrider-Fox, Town Manager Faye Lingo. Councilman Tim Hodges absent.

Bryan moved Truitt second to continue with the payment schedule with Lennar. Motion approved unanimously with Councilman Hodges absent.

8:02 Keenan moved Hastings second to adjourn.
