REGULAR COUNCIL MEETING
May 3, 2010

7:00 P.M. meeting called to order in the Council Chambers at 322 Wilson Highway, Millsboro, Mayor Larry Gum presiding. Present were Vice-Mayor Bob Bryan, Secretary Tim Hodges, Treasurer Michelle Truitt, Council Persons John Thoroughgood, Irene Keenan, Greg Hastings, Town Manager Faye Lingo, Town Solicitor Tempe B Steen, Development Coordinator Linda Johnson, Finance Director William Sauer, Town Clerk Tammy Phillips. Guests-- see attached.

Mayor Gum and Council presented Tempe Steen, Town Solicitor with a presentation. Ms. Steen will be retiring after 15 years of service as Town Solicitor.

PUBLIC HEARING - Public hearing was opened by Mayor Gum to hear tax appeals to the 2010-2011 tax year assessments. The assessment list has been posted. The town has not received any further appeals at this time. The hearing was left open until later in the meeting to hear any further appeals that might be presented and then closed.

SECRETARY'S REPORT - Secretary Tim Hodges presented the minutes from the April 5, 2010 council meeting for Council's approval. Bob Bryan moved, Michelle Truitt seconded to approve the minutes from the April 5, 2010 council meeting as written. Motion approved unanimously.

TREASURER'S REPORT - Treasurer Michelle Truitt presented the bills and bank balances to Council for approval. Tim Hodges moved, Bob Bryan seconded to pay the bills from the designated accounts as presented. Motion approved unanimously.

GREATER MILLSBORO CHAMBER OF COMMERCE- No Report.

MILLSBORO FIRE COMPANY - Ron O'Neal, President stated that they did not get FEMA Grant 2009 for gear and equipment. They will be applying for FEMA Grant 2010. Fireman Convention was held April 27 - May 2 at Parksley, VA a few of the men attended. On May 1, 2010, the new paid attendant started and will be working 40 hrs a week cross shifts. Members of the Fire Company participated with the Baskin-Robbins organization with their annual 31 Cent Scoop Night on Wednesday, April 28th. On April 23rd, past president Dwight Taylor passed away after 20 years of service to the Millsboro Fire Company'

MILLSBORO POLICE DEPARTMENT - Chief John Murphy stated that on April 6th - April 9th Sergeant Legates and Corporal Wheatley attend an Armorer's course in Abington, PA. April 26th - 30th we had in-house advanced training for all members of our DART team. Homeland Security threat level remains at yellow. No issues to report. Chief Murphy has requested for approval for Byrne Grants $ 12,000 to upgrade exercise equipment including blood pressure kit, scale, tactical team new computers for police dept, and has requested a SLEAF Grant $ 5823.87 to upgrade tactical team with 2 new digital audio/video recorder for the refurnished cars. Bob Bryan moved, John Thoroughgood seconded to approve the Byrne Grant $ 12,000 and the SLEAF Grant
$ 5823.87. Motion approved unanimously.

Close Public Hearing - As there were no further tax appeals to be heard John Thoroughgood moved, Bob Bryan seconded to close the Tax Appeal public hearing with no appeals presented. Motion approved unanimously.

PARKS AND RECREATION REPORT - No Report

STREET REPORT - No Report

WATER AND SEWER REPORT - Engineering contract amendments, Amendment No.5 Phase 1 Wastewater Treatment Facility Upgrade, $81,000. Construction Administration Contract E 2009 Wastewater and Beneficial Reuse Water Transmission and $ 85,000. Inspection Contract E Wastewater and Beneficial Reuse Water Transmission. Amendment No. 6 engineering services for Phase 1 Wastewater Treatment Facility Upgrade, $ 1,370,000.00. This it to ratify action taken last month. John Thoroughgood moved, Greg Hastings seconded to approve Amendment No 5 Upgrade $ 81,000, Contract E 2009 $85,000 and Amendment No 6 $1,370,000.00 an act to ratify a special meeting in April. Motion approved unanimously.

Sewer Adjustments due to water leak: 17 Nash Circle, Hub Court; 8 Nash Circle, Hub court; 416 Wilson Highway. Faye has adjusted sewer as ordinance allows.

Intervet- formal wastewater discharge permit. No action waiting for engineering recommendation.

MAYOR'S REPORT

  • Site Access Agreement Mallincrodt Veterinary Inc, and Intervet, Inc. are performing an investigation and remediation of the groundwater contamination that has impacted the public wells of the Town of Millsboro located on tax parcel 1-33-17.13-parcel 150. As you know EPA has taken over the clean up and part of that action is allowing the agencies to hire monitoring. Tim Hodges moved, Bob Bryan seconded to approve the site access agreement. Motion approved unanimously.
  • Council slate posted for council seats that are up for election, one seat in District 1 and one seat in District 2. Hodges in District 1 and Thoroughgood in District 2.
  • Retreat at Millstone committee report is ready for submission to council and any final action requires a public hearing as it is an amendment to the existing site plan, and set a date and time for a public hearing. Chairman Tim Hodges, commented the recommendation to council, which the report is in packet. Bob Bryan moved, Greg Hastings seconded to have Public Hearing June 7 at Council Chambers at 322 Wilson Highway, Millsboro at 7 pm. Motion approved unanimously.
  • Sign ordinance revision a new ordinance to replace the existing ordinance will be presented and council may set a date and time for a public hearing. We plan to send notices to businesses and property owners so they can review and have comments if they feel it is necessary. Hodges moved, Thoroughgood seconded to have Public Hearing June 7 at Council Chambers at 322 Wilson Highway, Millsboro at 7 pm. Motion approved unanimously.
  • Amend the description of the town's facilities lsiting, appendix D, special development district; no 2 change to water and wastewater improvements and or land purchase for wastewater disposal and no.8 to read specifically stormwater improvements for Wilson Highway. Thoroughgood moved, Bryan seconded to approve to amend the description of the town's facilities listing. Motion approved unanimously.

Bob Bryan moved John Thoroughgood seconded to recess the Regular Council meeting at 7:40 PM and to enter into an Executive Session at 7:45 pm to discuss legal and personnel issues.

8:05 pm meeting called to order with Mayor Larry Gum presiding. Present were Vice Mayor Robert Bryan, Secretary Tim Hodges, Treasurer Michelle Truitt, Council persons John Thoroughgood, Irene Keenan, and Greg Hastings, Town Solicitor Tempe Steen, Town Manager Faye Lingo.

Thoroughgood moved, Bryan seconded to continue with the legal firm Steen, Waehler & Schrider-Fox, LLC and have Mary Schrider-Fox serve as town solicitor for Millsboro.
Motion approved unanimously.

8:06 pm Bryan moved, Truitt seconded to adjourn. Motion approved unanimously.
